These Terms of Service (“Terms”) govern your access to and use of the GenMention website and service (the “Service”). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract source code from the Service
• Use the Service to violate any law or third-party rights
• Submit content that is unlawful, harassing, or infringing
• Resell or sub-license access to the Service without our written permission
• Use automated tools to overload our infrastructure or the third-party AI services we query on your behalf
• Submit keywords or queries designed to elicit illegal AI output

We may suspend or terminate accounts that violate these rules.

4. Subscriptions, Billing, and Refunds

Paid plans are billed in advance, monthly or annually as you choose. Payments are processed by Paddle.com, our merchant of record. By subscribing you authorize Paddle to charge your payment method on a recurring basis until you cancel.

5. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Some features depend on third-party AI providers (Perplexity, Google Gemini, Google Search) whose availability is outside our control. Scheduled maintenance will be announced in advance when feasible.

6. Intellectual Property

The Service, including its software, design, and content created by us, is owned by GenMention and protected by copyright. You retain ownership of the keywords, brand names, and other content you submit. You grant us a worldwide, non-exclusive license to use that content solely to operate the Service for you.

7. AI-Generated Content

The Service displays answers generated by third-party AI models (Perplexity, Gemini, Google AI Overviews). We do not author or verify these responses and are not responsible for their accuracy. You should independently verify any critical information.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or your misuse of the Service.

11. Termination

You may terminate your account at any time from the billing settings page or by contacting us. We may terminate or suspend your access for violation of these Terms with or without notice.

12. Governing Law
